Been there, done that!

Federal law says that any stream with a maintained width of 33 feet is considered a "navigable waterway" and is federal property.

County sheriff I spoke with was not overly concerned with the fed gummint's assessment of the situation, I was trespassing!
We got out without any charges, but just barely!
....and that was east Texas!
There's a bit of corruption in East Texas, even more so down on the border. I had a 2 hour encounter with a state GW on the border while two sheriff deputies watched, before the sheriffs showed up this guy at one point actually turned his body cam off. That dude ended up apologizing profusely over the phone later that evening, he was wrong and the federal GW thumped him pretty good (I was on fed property). Lemme back that out, he wasn't wrong he was intentionally trying to intimidate me to benefit the land owner across the road.
