This is totally wrong. Most of the laws we are used to, tell us what we can not do. However F&W regulations are Prima Facie laws, they tell us what we can do, anything else is illegal, i.e., method of take, you don't see knife, spear... listed, therefore those methods of take are illegal. Additionally, Prima Facie laws are based on first impression until proved otherwise. In other words, if you look guilty, you are presumed (I did not say assumed, big difference) guilty until proven otherwise. It's a very important concept to consider when being questioned by a Warden.

...and he's been questioned and had to educate GWs in the past. Listen to him.

I have been stopped by a game warden in this exact situation. I was sitting in the truck a within a unit for which I did not have a tag and glassing into a basin within the unit I had a tag. The GW asked to see my license and if I knew I was in the wrong unit. I said yes and explained the situation and that I knew what I was doing. He then checked the rifle to make sure a round wasn't chambered and left me alone.

I'm sure it would have been a different outcome had my rifle been loaded.
